Instructions for TN Extension for Canadian National
Once admitted in the TN status (TD for dependent family members), the period of
stay may be extended by petition to Immigration inside the U.S., or through the
same U.S. entry procedure as the initial admission indicated above.
Extension by U.S. entry
This requires the materials mentioned previously for initial entry in TN status
with the following change. The letter from your UCSB department must be a new letter
requesting a new one year period of "temporary employment" (attachment - extn 1)
(TN_extn_and_entry_ltr.pdf)
Extension by petition to Immigration inside the U.S.
The materials for the TN extension should be assembled and submitted together to
Tanya in OISS. Since the Immigration processing is sometimes very slow, this should
be started about 3 months before the current end date.
The required materials are as follows:
- Departmental Request letter (attachment - extn 2) (TNAttextn1.pdf)
- TN “Data Sheet” (attachment – extn 3) (TN_data_Jan_18.pdf
) completed and with Dept Chair’s signature
- Copy of I-94 form (both sides)
- Copy of I-94(s) of visa dependent(s)
- Copy of degree document, and translation into English where necessary
- $320.00 personal check payable to "U.S. Citizenship & Immigration Services" (for
the TN petition)
and for TD dependents:
- Additional $300.00 personal check payable to "U.S. Citizenship & Immigration Services"
for the dependent members holding the TD category
- Additional I-539 (http://www.uscis.gov/files/form/i-539.pdf) form which must be
completed by the TD spouse (the one form and fee covers all TD family members)
-
Copy of the marriage and/or birth certificate/documents for each TD family member.
Although we may extend the TN employment in increments of only one year at a time,
the petition to Immigration inside the U.S. enables continuation on payroll while
the petition is pending. If it is necessary to travel in and out of the U.S. before
we receive the TN approval notice, then the letter and procedure for extension through
U.S. entry will have to be followed.
Please remember to show your extension approval I-94 to your department payroll
person, so that your end date may be revised in the payroll system.
